1. Agreement
These Terms & Conditions ("Terms") govern your access to and use of the website, accounts, and paid services of Powers Creative Enterprises, LLC ("PCE," "we," "us"), a Wisconsin limited liability company. By using the site, interacting with our AI chatbot widget, or purchasing a service, you agree to these Terms. If you do not agree, do not use the site or make a purchase.
2. Services
PCE provides website design and development, AI integration, and branding & content services for small businesses. Our flagship product is The AI Front Desk, an AI assistant configured for a client's business that can answer visitor questions, qualify leads, capture contact information, and schedule bookings. Service-specific scope, deliverables, timelines, fees, and any service-level commitments are documented in individual project agreements, statements of work, or product descriptions at checkout, which control in case of conflict with these Terms.
3. AI chatbot and The AI Front Desk
This site includes an AI chatbot widget, and we may demo The AI Front Desk on our site or yours. Responses are generated by a large language model and may be inaccurate, incomplete, or out of date. They are provided for informational purposes only and do not constitute professional, legal, financial, medical, or other regulated advice. Do not rely on them as a substitute for a binding quote, contract, or professional consultation; pricing, availability, and scope are confirmed in writing by PCE before any engagement begins.
You agree not to (a) submit unlawful, harassing, infringing, or sensitive personal information (such as government IDs, payment card numbers, or protected health information) through the assistant; (b) attempt to jailbreak, prompt-inject, reverse-engineer, or extract the system prompt or another user's data; or (c) use the assistant to generate content that violates applicable law or the acceptable-use policies of our underlying AI providers. We may rate-limit, suspend, or terminate access to the assistant for abuse.
For clients who deploy The AI Front Desk on their own properties, PCE acts as a service provider/processor for end-visitor data under the client's services agreement and Data Processing Addendum. Performance commitments specific to that deployment are set out in the applicable order form.
4. Accounts
- You must be at least 18 years old (or the age of majority in your state) to create an account or make a purchase.
- You are responsible for the accuracy of the information you provide and for keeping your credentials secure.
- You agree not to misuse the site, attempt to disrupt it, or access it through unauthorized means.
- You will not use the site to violate any law or third-party right.
5. Payments
Prices for our services are displayed at checkout in U.S. dollars unless otherwise noted. By submitting a purchase, you authorize us, through our payment processor Stripe, Inc., to charge your selected payment method for the total shown at checkout, including any applicable taxes and fees.
PCE does not directly receive, store, or process your full payment card or bank account details; all payment data is handled by Stripe in accordance with PCI-DSS and Stripe's terms. By making a purchase, you also agree to Stripe's end-user terms.
For checkouts where Stripe acts as merchant of record (end-to-end compliance handling), Stripe processes the transaction, calculates and collects applicable tax, and handles refunds, chargebacks, and customer support relating to the transaction itself. Your bank or card statement for these purchases will show a descriptor that begins with LINK.COM* followed by our statement descriptor. For all other checkouts, PCE is the merchant of record and charges appear under our name.
6. Taxes
Prices shown do not include sales or use tax unless stated. We (or Stripe, on our behalf, on eligible checkouts) collect and remit Wisconsin sales tax and any other state, local, or value-added taxes required by law based on your billing address and the products purchased. You are responsible for any taxes, duties, or fees that apply to your purchase that are not collected at checkout, including any self-assessed use tax in your jurisdiction.
7. Subscriptions and recurring billing
If you purchase a subscription (such as Monthly Site Management or The AI Front Desk monthly service at $995/month following the $1,200 setup fee), your payment method will be charged on a recurring basis at the interval and price disclosed at checkout until you cancel. You may cancel a subscription at any time from your account dashboard or by contacting us; cancellation takes effect at the end of the then-current billing period and you will retain access until that date. Setup fees are earned on commencement of work and are non-refundable. Recurring charges already incurred are not refundable except as stated in Section 8 or required by law.
8. Refunds
Custom service work (website builds, design, AI integration, The AI Front Desk configuration, and social media services) is delivered to specification and is generally non-refundable once work has begun, except as expressly stated in your project agreement or as required by law. If you believe a charge was made in error, contact us within 30 days of the charge and we will review the request in good faith.
Monthly subscriptions may be cancelled at any time (see Section 7). Prorated refunds for partial months are not provided unless required by law.
You agree to contact us before initiating a chargeback or payment dispute with your bank or card issuer so we have an opportunity to resolve the issue directly.
9. Intellectual property
All content on this website — including text, graphics, logos, photography, code, and the configuration of our AI assistants — is owned by PCE or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.
Ownership of deliverables produced under a project agreement is governed by that agreement. Until full payment is received, all deliverables remain the property of PCE.
10. Client content
If you submit content to us (logos, copy, media, brand assets, knowledge-base documents used to configure The AI Front Desk), you represent that you own or have permission to use it, and you grant us a license to use it solely for the purpose of providing the services.
11. Third-party services
The site integrates with third-party services including Stripe (payments), Google (authentication), our AI / LLM providers, and our hosting, scheduling, and analytics providers. We are not responsible for the content, policies, or practices of those services. Your use of them is governed by their own terms and privacy policies.
12. Disclaimers
The site, AI assistant, and our content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of AI-generated output, and non-infringement. We do not warrant that the site or assistant will be uninterrupted, error-free, or secure, or that any specific business outcome (such as traffic, leads, bookings, or revenue) will result from our services.
13. Limitation of liability
To the maximum extent permitted by law, PCE and its members, managers, and personnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site, the AI assistant, accounts, or services. Our total aggregate liability for any claim shall not exceed the greater of (a) the amounts paid by you to PCE in the twelve months preceding the claim or (b) USD $100. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless PCE from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the site or services, your content, or your violation of these Terms.
15. Governing law and venue
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Wisconsin, and you consent to that jurisdiction and venue.
16. Changes
We may update these Terms at any time. Material changes will be reflected in the "Last updated" date. Continued use of the site or services after changes constitutes acceptance of the updated Terms.
