1. Agreement

These Terms & Conditions ("Terms") govern your access to and use of the website and services of Powers Creative Enterprises ("PCE," "we," "us"). By using the site, you agree to these Terms. If you do not agree, do not use the site.

2. Services

PCE provides creative services including web and brand development, live performance, and recording arts. Service-specific terms are documented in individual project agreements or proposals, which control in case of conflict with these Terms.

3. Use of the site

• You must be at least 13 years old to use this site.
• You agree not to misuse the site, attempt to disrupt it, or access it through unauthorized means.
• You will not use the site to violate any law or third-party right.

4. Intellectual property

All content on this website — including text, graphics, logos, audio, video, photography, and code — is owned by PCE or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

Ownership of deliverables produced under a project agreement is governed by that agreement.

5. Client content

If you submit content to us (logos, copy, media, brand assets), you represent that you own or have permission to use it, and you grant us a license to use it solely for the purpose of providing the services.

6. Payment

Fees, deposits, milestones, and refund terms for services are set out in the applicable project proposal or agreement. Late payments may incur fees and may suspend ongoing work.

7. Third-party services

The site may link to or integrate with third-party services. We are not responsible for the content, policies, or practices of those services.

8. Disclaimers

The site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure.

9. Limitation of liability

To the maximum extent permitted by law, PCE and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or services. Our total aggregate liability shall not exceed the amounts paid by you to PCE in the twelve months preceding the claim, or USD $100 if no amounts were paid.

10. Indemnification

You agree to indemnify and hold harmless PCE from any claims, damages, losses, or expenses arising out of your use of the site or violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Wisconsin, and you consent to that jurisdiction.

12. Changes

We may update these Terms at any time. Continued use of the site after changes constitutes acceptance of the updated Terms.
