Privacy Policy
1. Who we are
Powers Creative Enterprises, LLC ("PCE," "we," "us," or "our") is a Wisconsin limited liability company offering website design and development, AI integration, and branding & content services to small businesses. This Privacy Policy explains how we handle information collected through our website, customer accounts, paid services, and our AI products, including The AI Front Desk and the AI chatbot widget on this site.
2. Information we collect
- Information you provide: name, email, phone, company, project details, and any other content you submit through forms, account signup, or other communications.
- Account information: if you create an account, we store your email, a hashed password (or the OAuth identifier supplied by Google if you sign in with Google), display name, and account activity.
- Payment information: when you purchase a one-time service or subscription, payment is processed by our payment processor, Stripe, Inc. We do not see, store, or transmit your full card number, CVC, or bank account number. Stripe provides us with a transaction record that includes a payment identifier, the amount, currency, last 4 digits of the card, billing country, and your email address. We retain that record to fulfill the order, provide receipts, handle refunds, and meet tax and accounting obligations.
- AI chatbot widget data: when you interact with the AI assistant on our website, we (and our AI provider acting on our behalf) collect and process the messages you type, any contact details you provide in the conversation (such as name, email, phone, or company), the page the conversation started on, timestamps, language, approximate location derived from IP, and a session identifier. Conversations may be reviewed by us to respond to inquiries, improve the assistant, and prevent abuse.
- The AI Front Desk product data: when you demo or otherwise interact with The AI Front Desk on this site, we additionally collect any booking, scheduling, or intake details you submit (such as requested appointment times, service requested, address, and notes). For clients who deploy The AI Front Desk on their own properties, PCE processes their end-visitor conversations and booking data as a service provider / data processor on the client's behalf, under the client's services agreement; the client is the controller of that data.
- Automatically collected information: IP address, browser type, device information, pages visited, referring URLs, and approximate location, gathered through cookies and similar technologies. See our Cookie Policy.
- Communications: records of correspondence when you contact us.
3. How we use your information
- To respond to inquiries and provide services you request, including answering questions through our AI chatbot widget and routing qualified inquiries or bookings to us.
- To operate, monitor, evaluate, and improve The AI Front Desk and our AI chatbot widget, including reviewing transcripts to debug errors, tune responses, and reduce hallucinations and abuse.
- To create and operate your account and authenticate sign-ins.
- To process payments, deliver purchased services, manage subscriptions, send receipts and renewal notices, and handle refunds, chargebacks, and disputes.
- To calculate, collect, and remit applicable sales and use tax (including Wisconsin sales tax) and to keep tax and accounting records required by federal and Wisconsin law.
- To operate, maintain, secure, and improve our website and services.
- To send service-related communications.
- To comply with legal obligations and enforce our terms.
- To prevent fraud, abuse of the AI assistant (such as prompt injection or attempts to exfiltrate other users' data), and protect our rights.
We do not use the content of your chatbot conversations or AI Front Desk submissions to train third-party foundation models. Our AI provider processes inputs and outputs solely to generate responses for our application under a written data processing agreement that prohibits training on customer data.
4. Legal bases (EEA/UK users)
Where applicable, we process personal data based on your consent, the performance of a contract (such as fulfilling a purchase or returning an AI response to your question), our legitimate interests in operating our business, securing our systems, and preventing fraud, or compliance with legal obligations.
5. Sharing your information
We do not sell or rent your personal information. We share information only with:
- Stripe, Inc. — our payment processor. Stripe receives the data necessary to charge your payment method, calculate tax, screen for fraud, and process refunds and disputes. Stripe also acts as our merchant of record for end-to-end compliance handling on eligible checkouts, which means Stripe may collect and remit certain sales taxes, VAT, and GST on our behalf. Stripe's handling of your data is governed by the Stripe Privacy Policy.
- AI / LLM providers — messages, page context, and contact details you send through the AI chatbot widget or The AI Front Desk are transmitted to our underlying large-language-model provider (e.g., the Lovable AI Gateway and its upstream model providers) for the sole purpose of generating responses. Inputs and outputs are processed under contractual terms that prohibit using your content to train their models.
- Google — if you choose Sign in with Google, Google provides us with your email address, name, and a stable account identifier. Your use of Google sign-in is also subject to Google's privacy policy.
- Other trusted service providers — hosting, database, email delivery, scheduling/calendar, and analytics providers that process information on our behalf under written agreements.
- Authorities or other parties — when required by law, subpoena, or court order, or in connection with a business transfer such as a merger, acquisition, or sale of assets.
6. Payments, refunds, and tax records
Powers Creative Enterprises, LLC is registered in the State of Wisconsin. We collect Wisconsin sales tax where applicable. For checkouts where Stripe acts as merchant of record, Stripe calculates, collects, and remits tax directly to the relevant jurisdictions.
We retain payment records, invoices, and tax records for the period required by federal and Wisconsin tax law (generally at least four years from the date of the transaction or the filing of the related return, whichever is later), even if you later delete your account. Refund eligibility and timelines are described in our Terms & Conditions.
7. Cookies and tracking
We use cookies and similar technologies as described in our Cookie Policy. Payment pages additionally set cookies required by Stripe to process the transaction and detect fraud, and the AI chatbot widget uses local storage to keep your conversation in place as you navigate the site. These cannot be disabled if you choose to make a purchase or use the assistant.
8. Data retention
We keep personal information only for as long as needed to provide the services, to comply with legal, tax, and accounting obligations, to resolve disputes, and to enforce our agreements. Default retention periods:
- Account data: for the life of your account, then deleted within 90 days of account closure (excluding records we are required to retain).
- AI chatbot and AI Front Desk demo conversations: up to 12 months from the last message, after which transcripts are deleted or de-identified. Conversations flagged for abuse or fraud may be retained longer for security review.
- Booking and intake details submitted through The AI Front Desk on this site: retained until the inquiry is resolved, then up to 24 months for follow-up, unless you ask us to delete them sooner.
- Contact form and email correspondence: up to 24 months from last contact.
- Payment, invoice, and tax records: the period required by Wisconsin and federal law (generally at least four years).
- Server and security logs: typically 30–90 days.
9. Your rights and how to exercise them
Depending on your location, you may have the right to access, correct, delete, or port your personal information; to object to or restrict certain processing; to opt out of automated decision-making; and to withdraw consent. California residents have additional rights under the CCPA/CPRA, including the right to know, delete, correct, and opt out of the "sale" or "sharing" of personal information (we do not sell or share personal information as those terms are defined). We will not discriminate against you for exercising these rights.
How to request access or deletion: email us at privacy@powerscreativeenterprises.org (or use our contact form) with the subject line "Privacy Request." Tell us which right you want to exercise and, if you have an account, the email address on it. To delete an AI chatbot conversation, include the approximate date of the chat and the page it started on. We will verify your identity (typically by confirming control of the email address tied to the request) and respond within 30 days, or up to 45 days for complex requests. You may also authorize an agent to submit a request on your behalf.
We may not be able to delete records we are required to retain for tax, accounting, fraud-prevention, or legal-hold purposes, and we will tell you if that is the case. If we deny a request, you have the right to appeal by replying to our response, and to lodge a complaint with your local data protection authority or state attorney general.
For data processed by The AI Front Desk on a PCE client's website, PCE acts as a service provider/processor — please direct access or deletion requests to that business directly. We will assist them in fulfilling your request.
10. Security
We use reasonable administrative, technical, and physical safeguards to protect your information, including TLS encryption in transit, encrypted data storage, access controls, row-level security on our database, audit logging, and PCI-DSS-compliant payment processing through Stripe. No method of transmission or storage is 100% secure.
11. Automated decisions and AI disclosures
Responses generated by our AI chatbot widget and The AI Front Desk are produced by a large language model and may be inaccurate or out of date. They do not constitute professional, legal, financial, or medical advice. The assistant does not make legal or significant decisions about you without human review; PCE staff review qualified inquiries and bookings before acting on them.
12. Children
Our services are not directed to children under 13, and we do not knowingly collect personal information from them. Do not submit a child's information through the AI chatbot or booking forms.
13. International users
Our services are operated from the United States. If you access them from outside the U.S., your information will be transferred to and processed in the U.S. and in the regions where our service providers operate.
14. Changes to this policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent changes.
